Rules on FHA Repair Escrow

An FHA repair escrow allows a borrower to purchase a home that requires repairs. Lenders typically will not issue a mortgage for a home that requires repairs, but the FHA, or Federal Housing Administration, has created a repair escrow application for mortgages which is designed for the purchasing and repair of a property at precisely the same moment. The repair funds are placed into a separate account and utilized while the job is completed, as required.

Fix and Escrow Limits

The home the repair escrow is for shouldn’t need more than $5,000 in outside or interior repairs, and the repairs must be launched within 90 days of this loan finalization and completed over one year, as stated by the U.S. Department of Housing and Urban Development (HUD). The 90-day period is extended, at the discretion of HUD, for homes which need external repairs but are in an area experiencing inclement weather conditions. If the home is owned by HUD or a creditor, an amount equal to 110 percent of the repair estimation can be placed into the escrow. For other properties, the maximum escrow amount is 150 percent of the repair quotes.

Loan Documentation Requirements

HUD requires the loan underwriter to receive a set of files. Two bids from licensed contractors which obviously lineup itemize all repairs and the price for each are required, as well as a copy of the contractor’s license and a report from an FHA inspector detailing the job that’s necessary. The loan underwriter must establish the minimal escrow amount. HUD requires the sum to be either $500 or 150 percent of the repair price, whichever amount is higher, according to HUD. The party responsible for the money to be deposited into the account — the buyer or the vendor — must be clearly identified by the underwriter on the escrow documents. Once the job is completed, the creditor must receive a review report certifying the defect has been properly fixed and some other open invoices for the job.

Excluded Repairs

Fix escrows aren’t permitted even when repair cost is below $5,000. Any work that’s necessary for the home to be habitable is not allowed, because the home must be habitable for the first loan to be accepted. Roof, base and repairs to the house’s basic construction cannot be included at a repair escrow, as well as a method for plumbing, electricity or the transport of heating fuel, each HUD.
